1. General Terms

GM Strategies Pty Ltd (as applicable), and their subsidiaries and affiliates (“GMS Loans”) require you to comply with these online terms and conditions (the “Online Terms”) when using the GMS Online (collectively, the “Digital Channels”).

In the Online Terms, “you”, “your”, and “yours” refer to the person accessing the Digital Channels, and “we”, “us”, and “our” refer to GMS Loans.

Device means any equipment (electronic or otherwise) designed to be used to access your Account.

1.1 Acknowledgment & Acceptance

Please read this document carefully as it sets out the Online Terms under which you access and use the Digital Channels. Each time you use the Digital Channels, your use indicates your acknowledgment and acceptance of these Online Terms.

1.2 User Obligations

By using the Digital Channels, you agree that you must:

• Not provide GMS Loans with any information that is false, misleading, or incomplete, including, without limitation, in relation to your identity, financial position, or trading information or that of your business.
• Provide GMS Loans with your current and complete contact information and advise GMS Loans promptly if any of these details change.
• Not use your Account for any activity that is fraudulent, improper, or illegal.
• Immediately contact GMS Loans if you believe that your Account has been compromised, improperly accessed, or involved in any fraudulent or improper transactions.

1.3 About the Digital Channels

The Digital Channels allow you to access specific information about your GMS Loans products (“Account”), including viewing balances and instructing transactions. Not all products and services offered by GMS Loans are available through the Digital Channels.

These Online Terms do not affect the terms and conditions that apply to each of the products and services offered by GMS Loans. To the extent there is any inconsistency, the specific product terms prevail.

2. Changes to the Online Terms

We may vary the Online Terms from time to time. Notice of these changes may be published on the GMS Loans website at www.gmsloans.com.au, made available through the Digital Channels, or sent via electronic communication.

Where changes impose fees for using the Digital Channels, you will receive written notice at least 20 days before the changes take effect.

3. Jurisdictional Limitations

Not all GMS Loans products and services are available in all locations. Accessing the Website or Digital Channels outside your location may present information on unavailable products and services.

4. Intellectual Property

The content of the Digital Channels is the exclusive property of GMS Loans or used under license. Users may not use trademarks, logos, or any intellectual property without prior written permission.

All Content available through the Digital Channels is protected by copyright laws. Users may not modify, copy, distribute, or use Content for commercial purposes.

5. Costs

Use of the Digital Channels is free of charge, but standard fees for GMS Loans products and services still apply. Mobile or internet service providers may impose data or SMS charges.

6. Security

6.1 Your Security Responsibilities

You must take reasonable steps to safeguard your device, software, and security credentials. If your device has been jailbroken, security may be compromised, and GMS Loans is not liable for related losses.

6.2 Reporting Security Breaches

If you suspect unauthorized access to your Account, you must notify GMS Loans immediately.

7. Accessing the Digital Channels

Electronic services may experience interruptions. Access is provided on an “as is, as available” basis. GMS Loans is not liable for service unavailability.

8. Authentication

• GMS Online: Authentication through email and password.
• Two-factor authentication: Certain transactions require SMS codes.

9. No Warranty

Content is provided "as is" with no warranties on accuracy or reliability. GMS Loans disclaims all liability for errors or omissions.

10. No Advice

Information in the Digital Channels is general in nature and not financial advice. Applications for finance are subject to approval and terms.

11. Personal Information

We may collect information for analytics, research, and service improvement in accordance with our Privacy Policy.

12. Stopping Access or Use

GMS Loans may suspend or terminate Digital Channel access if fraud is suspected, the Account is suspended, or required by law.

13. Governing Law

These Online Terms are governed by the laws of New South Wales, Australia, and disputes shall be resolved in NSW courts.

14. Limitation of Liability

GMS Loans is not liable for losses arising from:

• Content errors on Digital Channels.
• Service unavailability.
• Security breaches or unauthorized transactions.
• Incurring mobile carrier charges.

15. Responsibility for Mistaken and Unauthorized Payments

Mistaken Payments

Entering incorrect BSB or account details may result in funds going to the wrong recipient and may not be recoverable.

Unauthorized Payments

You are not liable for unauthorized payments unless you contributed to the breach by not securing your Account credentials.
